Welcome to In the Wild! These Terms of Use (“Terms”) govern your access to and use of the In the Wild mobile application and related services (the “App”), operated by In the Wild, LLC (“we,” “us,” or “our”).
By creating an account or using the App, you agree to these Terms.
1. Eligibility
You must be at least 18 years old to use In the Wild.
By using the App, you represent and warrant that:
- You are at least 18 years old
- You have the legal capacity to enter into these Terms
- You are not prohibited from using the App under applicable law
We reserve the right to suspend or terminate accounts that violate this requirement.
2. Account & User Responsibilities
You agree to:
- Provide accurate, current, and truthful information
- Maintain the confidentiality of your login credentials
- Be responsible for all activity under your account
You may not:
- Create fake accounts or impersonate others
- Use another person’s account
- Misrepresent your identity, age, or intentions
3. Acceptable Use & Conduct
You agree NOT to:
- Harass, threaten, stalk, or harm other users
- Engage in hate speech, discrimination, or abusive behavior
- Share sexually explicit, violent, or illegal content
- Use the App for solicitation, scams, or commercial exploitation
- Promote illegal activity or unsafe behavior
We reserve the right to investigate and take action, including removing content or terminating accounts.
4. Real-World Interactions & Safety
In the Wild is designed to facilitate real-world connections.
By using the App, you acknowledge and agree:
- You are solely responsible for your interactions with other users
- You assume all risks associated with meeting people in person
- We do not conduct background checks or verify user identities
- We do not verify the identity, background, or intentions of users
- We do not guarantee the behavior, intentions, or safety of any user
You use the App and engage with others at your own risk.
5. Location Services & Check-Ins
The App may allow you to share real-time location or check in to venues.
By using these features, you agree:
- Location sharing is voluntary and can be controlled by you
- You are responsible for when, how, and with whom you share your location
- We are not responsible for any outcomes related to location sharing
6. User Content (Profiles, Photos, Messages)
You retain ownership of the content you submit.
However, by using the App, you grant In the Wild a:
- Non-exclusive
- Worldwide
- Royalty-free
- Transferable license
to use, display, reproduce, and distribute your content within the App for the purpose of operating and improving the service.
You agree that:
- You have the right to upload your content
- Your content does not violate laws or third-party rights
- Your content is not misleading, harmful, or inappropriate
We may remove content at any time.
7. Moderation & Enforcement
We reserve the right to:
- Review, monitor, and remove content
- Suspend or terminate accounts
- Restrict access to features
at any time, for any reason, with or without notice.
This includes the right to remove users who we believe pose a risk to the community.
8. Account Termination
We may suspend or terminate your account at any time, with or without notice, for any reason, including if you violate these Terms or pose a risk to the community.
You may delete your account at any time through the App.
Upon termination, your right to use the App will immediately cease.
9. Paid Features & Subscriptions
Some features require payment, including subscriptions or event access.
By purchasing, you agree:
- Payments may be processed through Apple, Google, or other providers
- Subscriptions may automatically renew unless canceled
- Billing and cancellations are handled through the platform you purchased on
- If you purchase through Apple or Google, their terms may also apply
All purchases are non-refundable except as required by applicable law or the policies of the platform through which you made the purchase (such as Apple or Google).
We may modify pricing or features at any time with notice.
10. Third-Party Services
The App may integrate with third-party services (e.g., payment processors, identity verification providers, location services, or event providers).
We are not responsible for:
- Third-party content or services
- Their availability, accuracy, or policies
Your use of third-party services is subject to their terms.
11. Intellectual Property
All App content, including:
- Branding
- Logos
- Design
- Software
is owned by In the Wild or its licensors and protected by law.
You may not copy, distribute, modify, or exploit any part of the App without permission.
12. Disclaimer of Warranties
The App is provided “as is” and “as available.”
We do not guarantee:
- The App will be uninterrupted or error-free
- Matches or connections will be successful
- User behavior or intentions
- Safety of interactions
We may modify, suspend, or discontinue the App or any features at any time without notice.
13. Limitation of Liability
To the fullest extent permitted by law:
In the Wild shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of data, revenue, or opportunities
- Any harm resulting from interactions with other users, whether online or offline
Our total liability shall not exceed the greater of:
- The amount you paid us in the past 12 months, or
- $100
14. Indemnification
You agree to defend, indemnify, and hold harmless In the Wild, its owners, employees, and partners from any claims, damages, or liabilities arising from:
- Your use of the App
- Your content
- Your interactions with other users
- Your violation of these Terms
15. Force Majeure
We are not liable for any failure or delay in performance resulting from events beyond our reasonable control, including but not limited to natural disasters, internet outages, government actions, or service disruptions.
16. Dispute Resolution & Arbitration
Any disputes arising out of these Terms shall be resolved through binding arbitration, not in court.
You agree to:
- Waive your right to a jury trial
- Waive participation in class actions
The arbitration will be conducted on an individual basis and not as part of a class, consolidated, or representative action.
17. Governing Law
These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles.
18. Changes to These Terms
We may update these Terms at any time.
If changes are material, we will notify you via the App or email.
Continued use of the App means you accept the updated Terms.
